Der Versorgungsausgleich in Japan – Ausgleich, Folgen und Verfahren nach der Reform von 2008

Abstract

The article deals with the new Japanese legislation on pension rights adjustment at the time of divorce with regard to the national pension reform in 2004. As a result of this reform, new rules on pension division were added in the Japanese Social and Welfare Act. The rules provide for two systems, the first one took effect in 2007, the other in 2008.

The authors explain the reform with regard to the Japanese national pension system and discuss the substantive rules of the new legislation, the procedures and the practical consequences. Finally, they compare the act to the new German Pension Division Act.
