Zwei aktuelle Urteile zur gleichgeschlechtlichen Ehe
Abstract
This article analyses the legal debate surrounding the introduction of same-sex marriage, highlighting two recent decisions on the issue. On March 2021 the Sapporo District Court ruled that current rules under the Civil Code and Family Registration Act violated the Constitution. Its decision was based on Article 14 of the Constitution, i.e., the principle of equality. In June 2022, the Ōsaka District Court rendered a decision at odds with the first court’s assessment but hinted that the current rules may prove unconstitutional in a future case under Article 24(2).
