Straftaten bei unbefugtem Zugang zu Computern
Abstract
This paper discusses the criminal offense of unauthorized access to computers in Japan. The unauthorized access offense was not created in order to protect information security directly, but to prevent online impersonation. It captures actions of an unauthorized use of an identification code of another person and actions to circumvent the access control feature which controls the use of identification codes. Since the relevant terms are defined in a statute using complicated definitions, this paper illustrates the purposes and reasons for the offense and points out problems and issues to be addressed in the future.
