Abstract

The contribution is based on a lecture presented at the University of Vienna. It deals with current problems of consumer contract law in Japan. The author contrasts the present regulation with the pending proposals for a reform of the Japanese Civil Code. The reform draft of 2009 pays special attention to the control of standard contract terms. The authors discusses, among others, the regulation of abusive contract clauses and the rights of consumers in the case of non-performance under the old and the prospective new law.
