Abstract
This article deals with legal transactions concluded by persons who are not fully legally competent. This problem arises above all at the beginning and end of life, but also in the case of permanent and temporary mental incapacity. In practice, therefore, we are dealing with three problem areas. The author shows that both legal systems are formally divided into transactions by minors and transactions by adults. Moreover, the Japanese legal framework seems more practicable for the first category of cases, and the German legal framework for the second category.
